Terms of Service for PhysioAI

Welcome to PhysioAI, India's AI powered physiotherapy education and clinical reasoning platform. These terms and conditions apply to the PhysioAI app for mobile devices, and web browsers (v1.6.7, com.physioai.prephub), together with any related services operated by Auraflex Intelligent Healthcare Services Private Limited, Karjat, India (collectively, the "Application" or "Services"). Auraflex Intelligent Healthcare Services Private Limited is hereby referred to as the "Service Provider".

By accessing or using our Application, website, or any related services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Services. You should read them carefully before using the Application.

These Terms apply to all users of PhysioAI, including students preparing for PGPCET, CPTE, NPTE, DHA / HAAD / ACPC, and other examinations, as well as clinicians using our Clinic OS tools.

PhysioAI is a freemium product. Subject to your compliance with these Terms, the Service Provider grants you a limited, non exclusive, non transferable, revocable license to install and use the Application on a mobile device or computer for personal or internal business purposes (study / clinical reasoning practice).

You agree not to:

• Copy, modify, distribute, sell, or lease any part of our Services or included software.
• Reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application. Including attempts to extract the source code of our AI models, including Axon, Synergist, or LogicX. Except as expressly permitted by applicable law.
• Translate the Application into other languages or create derivative versions without permission.
• Share your account credentials or allow others to access your account.
• Use automated tools or bots to access or scrape content from the platform.
• Use the Services for any unlawful purpose or in violation of any applicable regulations.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices.

Unauthorized copying, modification, or extraction is strictly prohibited.

PhysioAI is an educational and clinical reasoning support tool. It is not a substitute for professional medical advice, diagnosis, or treatment. All content generated by Synergist AI, LogicX DDx Engine, Red Flag Spotter, Axon, and related tools is intended solely for educational purposes and clinical reasoning practice.

Always seek the advice of a qualified healthcare professional before making clinical decisions. PhysioAI and Auraflex Intelligent Healthcare Services Private Limited shall not be held liable for any clinical decisions made based on content generated by the platform.

Do not enter real patient Protected Health Information (PHI) into the Services. Use only hypothetical / non PHI scenarios (see Privacy Policy).

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your information updated. You are responsible for safeguarding your password and for all activities under your account.

• You must be at least 16 years of age (age of digital consent; US COPPA floor 13) to use the Application. If below that threshold, a parent or legal guardian must review and accept these Terms on your behalf, where permitted by law.
• You may delete your account at any time from Profile / Settings to Delete Account (or via support@physioai.in). Upon deletion, personal data is removed within 30 days per our Privacy Policy, except where retention is legally required.
• It is your responsibility to maintain the security of your mobile device or computer and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your device. It exposes you to malware, compromises security features, and may break the Application.

PhysioAI offers both free and paid subscription tiers (freemium; purchases via Apple App Store / Google Play, processed by RevenueCat). By subscribing to a paid plan, you agree to pay the applicable fees. All payments are processed securely through our payment partners. We never see full card numbers.

• Subscription fees are billed in advance on a monthly or annual basis.
• Refunds are handled case by case. Contact support@physioai.in within 7 days of purchase if you experience issues. Statutory / store mandated refund rights (Apple / Google, EU / consumer law) are unaffected.
• PhysioAI reserves the right to modify pricing with 30 days advance notice to active subscribers. Continued use after the notice period constitutes acceptance; otherwise cancel before renewal.
• Deleting the app alone does not cancel auto renewing subscriptions. Cancel in the App Store / Play Store. The Service Provider may modify the Application or charge for services at any time; charges will be clearly communicated.
• Nothing in these Terms limits rights you have under applicable consumer protection laws that cannot lawfully be excluded.

The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding (the "IP").

All content on the PhysioAI platform. Including but not limited to the Axon Clinical Knowledge Graph, Synergist AI engine, LogicX DDx Engine, Red Flag Spotter, MCQ Bank, OSCE simulators, Study Strategist, Case Builder, and all associated software. Is the exclusive intellectual property of Auraflex Intelligent Healthcare Services Private Limited. Unauthorized reproduction or commercial use is strictly prohibited.

Nothing in these Terms grants you any license or right to use the Service Provider trademarks, logos, or branding for any purpose.

The Application allows users to post, share, or upload content (PDFs, photos, voice, clinical scenarios, queries, support messages, simulator inputs). You agree not to post content that:

• Is illegal or violates third party intellectual property rights (copyright, trademark, patents)
• Is abusive, threatening, harassing, defamatory, or hate speech
• Contains discrimination or incitement to violence or illegal activity
• Is spam, phishing, or contains malware
• Violates the privacy or personal data rights of others (including real patient PHI. Prohibited)
• Is misleading, false, or deceptive
• Contains explicit violence or sexual content (unless age gated appropriately)

The Service Provider reserves the right to:

• Remove or disable access to violating content
• Suspend or terminate accounts of repeat violators
• Cooperate with law enforcement if illegal content is reported
• Moderate, filter, or hide content violating these Terms or applicable law

Content you submit may be visible to other users or the public depending on how the Application functions (e.g. shared cases, leaderboards, community features).

Reporting and appeals

Report violations to support@physioai.in with enough detail to identify the content and contact you for follow up. Where in app report / block / mute features exist, those reports are reviewed to the same standard. The Service Provider may review, request more info, remove / restrict content, and act against the account; affected users may appeal at support@physioai.in and will receive reasons within a reasonable period, subject to applicable law.

License you grant us

By submitting User Generated Content you grant the Service Provider a non exclusive, worldwide, royalty free license to use, reproduce, distribute, prepare derivative works of, display and perform the content in connection with the Application and its business. This does not grant a right to sell or sublicense your content independently of the Application. You warrant you own or control the rights and that the content complies with these Terms and law. Personal data in UGC is governed by the Privacy Policy. Do not post personal data of others without consent.

The Application utilizes third party services that have their own Terms and Conditions:

The Service Provider accepts no liability for loss, direct or indirect, from relying entirely on third party information via the Application, or for third party content inaccuracies.

• Some functions require an active internet connection (Wi Fi or mobile data). The Service Provider is not responsible if the Application cannot function at full capacity without connectivity or after data exhaustion.
• Mobile / ISP terms still apply: you accept responsibility for data / roaming / provider charges, including use outside your home territory without disabling roaming. If you are not the bill payer, you confirm you have their permission.
• Keep your device charged. The Service Provider is not responsible if a dead battery blocks access.
• Updates: the app is provided for current OS requirements, which may change; download updates to keep using it. If you refuse updates, support for older versions may end and features may break. The Service Provider does not guarantee perpetual updates, and may cease providing the Application at any time; on termination (a) licenses end, (b) you must stop using and delete the app unless told otherwise.
• AI clause: the Application incorporates AI to process data and deliver features (see Privacy Policy for details). By using it you acknowledge AI processing, which the Service Provider keeps compliant with applicable law and oriented to user benefit.

To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption, even if advised of the possibility of such damages. This includes, to the maximum extent permitted by applicable law, PhysioAI and Auraflex Intelligent Healthcare Services Private Limited for claims arising from your use of the Services.

However, the Service Provider retains full liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; and any other liability that cannot be excluded or limited under applicable law.

Cap: to the fullest extent permitted by law, total liability for any claim shall not exceed the amount you paid for the Application in the 3 months preceding the claim (per your landing page term; generator default is 12 months. 3 months applied as the more specific agreed term), or the minimum amount required under applicable law, whichever is greater. If the free tier is used, liability is limited to the minimum permitted by law.

To the fullest extent permitted by law, you agree to indemnify and hold harmless the Service Provider, its affiliates, officers, directors, employees and agents from claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or directly related to your breach of these Terms or intentional misuse of the Application, including violating UGC you submit.

This does not apply to claims arising from any negligence, breach, or legal violation by the Service Provider. Where consumer indemnification is restricted by law, this clause applies only to the maximum permitted extent.

We reserve the right to suspend your access if you materially breach these Terms, with written notice and. Where curable. 14 days to remedy; failure to cure may lead to termination. We may suspend or terminate immediately without notice if you violate applicable law, infringe IP rights, or engage in activity harmful to other users, third parties, or us.

We may also suspend / terminate for conduct we believe violates these Terms or harms users / us / third parties, or for any other reason permitted by law. Upon termination, your right to use the Application ends and you must delete all copies from your devices.

Termination does not affect accrued rights, subscription fees already due (subject to refund rights), or the IP / liability / governing law clauses.

These Terms shall be governed by and construed in accordance with the laws of India, excluding conflict of law rules, except to the extent mandatory consumer protection laws provide otherwise. Any disputes are subject to the exclusive jurisdiction of the courts located in Maharashtra, India. Without limiting any right you have to bring a claim in a court competent under mandatory law.

EU DSA note (to the extent the Application qualifies as an intermediary service under Regulation (EU) 2022/2065): point of contact support@physioai.in; content restriction decisions come with a statement of reasons (basis plus redress); illegal content notices are processed promptly with human review where needed and acknowledged electronically; moderation disputes may go to a certified Article 21 out of court body without affecting judicial remedies; transparency reports available on request at support@physioai.in. These do not replace consumer / data protection rights.

We may update these Terms from time to time. Material changes will be notified by posting the new Terms on this page with an updated date (and, where appropriate, in app / email notice). Previous versions are maintained and available on request at support@physioai.in. Your continued use after changes constitutes acceptance; where law requires fresh consent, it will be sought separately.

These terms and conditions are effective as of 11 September 2026.

If any provision is held invalid, illegal, or unenforceable, it is modified to the minimum extent necessary to become valid, and the rest remains in full force.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider concerning your use of the Application, superseding prior agreements or understandings.
